 Introducing the Firearms Control Act (FCA) 2004

We have produced a two-page briefing document summarising the FCA. Here is the full Firearms Contol Act and the subsequent Firearms Control Amendment Act.

Gun ownership is not a right in South Africa. It is a privilege granted by the state and is strictly controlled by the FCA.

The FCA is a comprehensive gun control law designed to:

  • Protect people’s constitutional rights to life and freedom from harm (or “bodily integrity”)
  • Prevent crime by
    • Stopping the flow of legal guns into the pool of illegal guns
    • Removing illegal guns from society
    • Improving control over legal guns
  • Give the state powers to remove illegal guns; control the sale, use and storage of legal guns; detect and punish careless or criminal use of firearms.

The government is very serious about gun control because the level of gun violence in South Africa is so high.
